TERMS + CONDITIONS

Please read our Terms and Conditions (“the Terms”) carefully and make sure you understand them before you make a purchase. By making a purchase you agree to be bound by these Terms. We may amend these Terms from time to time by posting a revised version on our site. Every time you make a Booking, the Terms in force at that time will apply to your purchase.

INFORMATION ABOUT US

‘A Fine Balance’ refers to a group of businesses and independent freelance instructors that deliver services to you, the client. The A Fine Balance group of businesses are as follows:

  • A Fine Balance Limited (company no 11224414) - A Fine Balance Limited acts as an agent for the independent freelance Instructors that deliver the services to you, the client. A Fine Balance Limited is responsible for operations, communications, booking processes and the studio at 173 St Marys Lane, Upminster. The Instructors are responsible for the delivery of the services and instruct us to facilitate the operations. Instructors abide by our terms and conditions but operate independently. These services are mainly delivered at 173 St Marys Lane in Upminster operated by A Fine Balance Limited, but do also take place at other locations.

  • Hannah Horne operating as A Fine Balance Yoga (sole trader) - Hannah Horne is a sole trader and freelance instructor directly delivering private 121 and small group yoga services and events.

  • This website www.afinebalance.me is operated by the above businesses.

FOLLOWING DEFINITIONS APPLY

  • “Service” means any activity delivered by the Instructor, e.g. classes, workshops, courses, retreats, events, private / 121, at any location the A Fine Balance group of businesses operates in. All services are subject to the following Terms. A Fine Balance reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of A Fine Balance and/or the conduct of Students. Any such changes will be published on the Website and, until revoked, are binding on Students.

  • In these Terms “we”/”us”/ “our” / “A Fine Balance Studio” / “A Fine Balance” means A Fine Balance Limited / the independent instructors that deliver the services and A Fine Balance Yoga / Hannah Horne.

  • “Student” / “you”/ ”your” / ”yours” means you, the direct client.

  • “Registration Form” means the registration form and waiver completed by a Student electronically via MINDBODY when signing up to join the services.

  • “Studio” means 173 St Marys Lane, Upminster, RM14 3BL and any other location where our services are operated, for example (and not limited to), corporate workplace premises, students’ homes and others.

  • “Website” means www.afinebalance.me and “online” refers to any services that are live-streamed virtually or are recorded and shared digitally.

  • These Terms also apply (as applicable) to a person who attends without payment, for example, as part of a promotional or other arrangement but has not purchased a Service.

  • These Terms and any disputes arising from them shall be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

OTHER TERMS AND POLICIES

Purchasing and participating in our services means you adhere to our Liability Waiver. We use your personal information in accordance with our Privacy Policy.
Please take the time to read these documents as they include important terms which apply to you.

SECURITY CAMERA

Please note: we have a security camera in place livestreaming at A Fine Balance Studio 173 St Marys Lane.

BOOKINGS + TIMETABLE

Please note for all purchases:

  • All Services must be pre-booked and paid for in advance. It is not possible to book on arrival.

  • It is your responsibility to ensure that you have made the correct booking and submitted payment correctly. Purchases are non-refundable.

  • If you have a multiple class pack - booking a session automatically deducts a class from the pack and the cancellation policy applies.

  • If a member, all classes included in your chosen membership type will have no cost attributed to them. Additional Services / classes /workshops / courses must be paid for at the time of booking.

  • All purchases are assigned to one Student and ownership cannot be transferred, deferred or refunded.

  • We reserve the right to review and change the price of our classes and memberships at our sole and absolute discretion.

  • All classes are offered by us subject to availability. We do not guarantee availability at any time.

  • We reserve the right to cancel services at last minute. If you are booked into a session at the time of cancellation, we will offer: Class pass holders and Credit-based Members - Recredit your account with the class credit or the price of the cancelled class; or a refund if you made payment via the single class / drop-in option; Unlimited Members – We will try to book you into another session and if not possible, offer £5 credit towards a future services. A Fine Balance Limited will not be liable for any other incurred costs or damages caused to you from a cancellation.

  • We operate a reduced timetable at certain times of the year such as Bank Holidays, school holidays and the Christmas period, including closure on Christmas Day and Boxing Day. All memberships and class passes include this.

  • Instructors and classes are subject to change.

  • Any fees paid up front for any Service or membership will not be refunded.

CANCELLATION POLICY

Please note our 12 hours Cancellation Policy when booking. By purchasing with us, you confirm you have read and accepted our full terms and agree to our 12 hours cancellation policy.

HOW TO CANCEL

In order to cancel your class and return it to your account or if a member, to not receive a penalty cancellation charge, you must cancel 12 hours prior to class start time. Once your class is cancelled, the class pass will be returned to your account to be used at a future date; the class is not monetarily refunded. You can cancel your class booking in the following ways: 

·       Log into your account here, next to the class you wish to cancel, press “cancel”; or

·       Use the mindbody app on your smart phone.

PENALTIES FOR LATE CANCELLATIONS + NO SHOWS

Early cancellations (cancel at least 12 hours before start of class) - You can cancel class bookings up to 12 hours in advance only. If you paid by class pass, your class will be credited back to your account.

Late cancellations and no shows (within 12 hours before start of class) - We understand that cancellations are sometimes unavoidable – but cancelling late or not attending at all often stops other students from booking places in that class. 

  • Class pass holders: If you do not cancel a class booking at least 12 hours of the class start time, you will lose the class pass and it will not be credited back to your account.

  • Members and Intro / Trial Offer pass holders: If you have signed up for the monthly / unlimited memberships or Intro Offer and you late cancel an in-studio class you will be charged £5. If you do not cancel at all and do not show up to an in-studio class, you will be charged £10. This information is also found in your contract / when you sign up. This will be charged to the card that your pass / membership payment is taken from. Our aim is to improve the A Fine Balance experience for everyone and make it easier for all students to be able to attend the classes they want to.

Courses and workshops - Courses and workshops cannot be cancelled or refunded - once purchased you have committed to the payment.

121 and private sessions - We operate a strict 24 hour cancellation policy on behalf of the Instructors. For cancellations made with less than 24 hours notice or if you do not turn up for your appointment, you will be charged the full appointment fee in these circumstances.

 

ARRIVAL + LATENESS

Please arrive 5-10 minutes early.

If you arrive late, you will not be able to attend the class - out of respect for the Instructors and other students.  This will be treated as a late cancellation. Please always check in with the Instructors before your class, otherwise we will charge you as a no-show.

WAIT LIST

If a class is full, you can join the wait list. Make sure you have opted in to emails, as you will be emailed if a space becomes available. Please check your emails, if you are added to the booking, you will be charged or it will be removed from your class pass.

GENERAL / RULES

·        What if I have an injury? Please inform the Instructors of any injuries at the start of the class. You need to take things at your own pace and rest when needed. We ask students to take responsibility for their injuries, modify and listen to their bodies.

·        Clean mats and props For hygiene reasons and to respect the next person, please always clean mats and props with the sanitising wipes after use.

·        No leaving early To avoid disrupting others, we ask you to stay for the entire class especially Savasana. Please refrain from leaving before the class has finished. This may mean parking your car somewhere that allows you to stay for the full practice including the time needed to arrive and leave calmly.

·        Shoe-free zone A Fine Balance is a shoe free zone. All outdoor footwear is to be removed at the entrance to the Studio.

·        Glass-free zone For safety reasons and because all customers are barefoot – no crockery, glass or anything breakable is permitted in any part of the Studio.

·        Fire alarm In the event of a fire you are asked to exit out of the nearest door (at the front or back of the Studio).

·        We reserve the right to refuse entry or expel you from the Studio should your conduct be deemed unfit or should they be deemed to be in breach of the Terms. In such instances, A Fine Balance Limited will not refund you.

SOCIAL MEDIA + MARKETING

Please be advised that photographs and videos may be taken for use on the A Fine Balance website, marketing materials, social media and all other. By taking part in these sessions, you grant the right for A Fine Balance to use these images for publicity purposes.

PURCHASES:

INTRODUCTORY OFFER / TRIAL PASSES

The Intro Offer / Trial Passes / Welcome Back offers can only be purchased once per person. We regularly check the system for duplicate accounts, anyone found breaching the terms of this trial will be charged the difference between the trial value and the full value of the classes used. We reserve the right to take this payment and close all duplicate accounts without prior notification. Please note this trial is non-transferable, non-refundable, and cannot be paused or extended.

MEMBERSHIPS

AUTOPAY MEMBERSHIPS

  • ‘Cancel anytime’ autopay membership can be cancelled with at least 48 hours notice (any less and the payment may already be processing and no refunds will be given). You must cancel yourself via your own MINDBODY account cancellations via email will not be taken into account. Cancellations are immediate, so once cancelled you can no longer book classes (even if your membership had time left on it).   • Payment is monthly in advance. You will not be able to book next month's classes until payment has been made.

  • You cannot carry over unused classes at the end of each month, the class passes will expire, and the new month membership of only 5 sessions will restart.

  • If we attempt to take a payment and it fails, there is a £10 admin charge for missed payments. We will pause your membership until payment is made.

  • Please note our 12 hour cancellation policy, you will be charged £5 if you do not cancel your class space with 12 hours or more notice and you will be charged £10 for not cancelling at all.

  • Please note we operate a reduced timetable at certain times of the year such as Bank Holidays, school holidays and the Christmas period, including closure on Christmas Day and Boxing Day. All memberships and class passes include this.

  • Instructors and classes are subject to change.

  • We will cancel classes with 2 or less people booked into them so make sure to book into the sessions you want to attend in advance.

  • We operate a reduced timetable during school holidays and public holidays - this is included in your membership and you will not be reimbursed for the reduced timetable.

  • This membership cannot be refunded, transferred and prorated.

  • £5 off workshops is automatically applied at checkout.

PAY UP FRONT MEMBERSHIPS

If you have signed up to a ‘pay up front’ membership (e.g. 1, 3, 6, 12 months), you cannot cancel your membership and are not eligible for a refund.

12 Months Annual Membership

  • Membership includes: unlimited Upminster studio classes.

  • You cannot carry over unused classes at the end of the year.

  • Please note our 12 hour cancellation policy, you will be charged £5 if you do not cancel your class space with 12 hours or more notice and you will be charged £10 for not cancelling at all.

  • Please note we operate a reduced timetable at certain times of the year such as Bank Holidays, school holidays and the Christmas period, including closure on Christmas Day and Boxing Day. All memberships and class passes include this.

  • Instructors and classes are subject to change.

  • We will cancel classes with 2 or less people booked into them so make sure to book into the sessions you want to attend in advance.

  • We operate a reduced timetable during school holidays and public holidays - this is included in your membership and you will not be reimbursed for the reduced timetable.

  • This membership cannot be refunded, transferred and prorated.

  • £5 off workshops is automatically applied at checkout.

CLASS PASSES / PACKS

Class packs expire on the date stipulated at point of purchase. They can be extended for one further month for an additional charge of £10. Class packs can only be extended once.

Intro Offer and monthly memberships cannot be extended.

DAY RETREAT AT PAUS

The Day Retreat at Paus is ran by Hannah Horne operating as A Fine Balance Yoga. Booking confirms commitment to attending the Day Retreat regardless of reason for cancelling. Refunds will not be given. If you can find another person to take your place then that would be OK, but otherwise payment means no cancellation or refund is possible.

ROOFTOP YOGA

Rooftop Yoga is delivered by independent freelance teachers at BrewDog in Upminster subject to weather. Booking commits you to that session and cannot be cancelled by the student. The only time refunds will be offered and cancellations possible if there is heavy rain forecast. The sessions will still go ahead in cold weather so please bring warm clothes to wrap up.

GROUP YOGA CLASSES IN DUNMOW

The booking process for Group Yoga classes delivered in Dunmow are operated by A Fine Balance Limited.

121 PRIVATE YOGA

A Fine Balance Limited manages the booking process for private 121 sessions delivered by independent freelance teachers at the studio on 173 St Marys Lane and at locations within 30 minutes of RM14 3BL

Hannah Horne operating at A Fine Balance Yoga delivers all 121s and private sessions within 20 minutes drive of Dunmow, CM6 1BQ.

CONCESSIONS & DISCOUNTS

·     Concessionary discounts are offered to full time students, seniors over 65, job seekers and those registered as disabled. The concessionary discount is 20% off all drop in and class passes (excluding promotional passes and community classes). Please email us with relevent I.D. for concessionary promo code.

·     No discounts or concessions are available on our monthly Direct-Debits, Drop-In passes or Introductory Offer.

·     No additional discounts or concessions are available in conjunction with any special offers.

·     Only one discount or concession can be applied at one time.

TEACHING ARRANGEMENTS

A Fine Balance Limited acts as an agent for the independent freelance Instructors that deliver the services to you, the client. A Fine Balance Limited is responsible for operations, communications, booking processes and the studio at 173 St Marys Lane, Upminster. The Instructors are responsible for the delivery of the services and instruct us to facilitate the operations. Instructors abide by our terms and conditions but operate independently.

POLICIES CONTINUED

Compensation
We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:
• your own fault;
• a third party unconnected with the provision of our services; or
• events which we could not have foreseen or avoided even if we had taken all of the responsible precautions our liability to compensate you (other than in the case of personal injury or death caused by our negligence) will be limited to £250 having regard to such factors as whether the loss of damage was due to a negligent act or omission by us.
Our liability to compensate you (other than in the case of personal injury or death) will be limited to a reasonable amount having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.

Force Majeure
We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms , if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
Waiver
No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.

Severability
If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

Data Protection
We, A Fine Balance Limited, will use your personal details and information to provide you with use of our services and facilities, to administer and maintain our membership records, to process your application and payments, to verify your identity and to carry out market research. We may keep your information for a reasonable period for these purposes. We may share your information with our service providers in order to provide you with A Fine Balance Limited services, and with other third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how we use your information, please let us know by contacting hello@afinebalance.me. You hereby consent to the use of your information, including sensitive personal data relating to your health and fitness, for the reasons and in the manner set out above.

Personal Belongings
Personal belongings brought to the Studio are at your own risk. The safety of the possessions are not the responsibility of A Fine Balance Limited. We do not accept liability for loss or damage of personal possessions except in so far as such loss or damage is by law incapable of exclusion. All lost and left property will be disposed of within 14 days.
